What is Medical Negligence?

Medical Negligence is when a patient has received poor medical care from a medical professional, which has caused the patient to directly suffer harm or caused an existing condition to worsen. Medical negligence can occur through various ways such as misdiagnosis, incorrect treatment given or surgical mistakes.

Are There Limitations for Making a Medical Negligence Claim?

You are expected to make a claim within three years from the date you realised the treatment you received was substandard. However, there are some exceptions to this rule:

Children – claims involving a child can be made at any point before the child’s 18th birthday. On their 18th birthday, the three-year rule will come into effect for a claim to be made. This means claims must be started before they turn 21, otherwise this will be out of timescale.

Mental Capacity – if an individual has suffered medical negligence but does not possess the mental capacity to make a claim themselves, then there is no time limit for a claim being made on their behalf.

Fatality – when a fatality has occurred, then the three-year time limit runs from the date of death (assuming there was a right of action at the time of death).
